Terms of Use

These Terms of Use govern access to the LabourDeskApp public website and platform. By creating an account, selecting a subscription or using the platform, a user accepts these terms and any applicable plan, checkout or service information.

If a person does not accept these terms, that person should not use the platform. These terms are a controlled public foundation and are not presented as independently verified legal advice.

LabourDeskApp is a structured labour-relations platform operated by Labourdesk (Pty) Ltd. It supports employers with workplace information, processes, documentation, compliance activities and dispute preparation within available functionality.

A user must have the legal capacity and appropriate authority to create or use an account. A person acting for an organisation confirms that the person is authorised to act for that organisation and use its information for the intended purpose.

Users must provide accurate registration and organisation information and keep relevant account details reasonably current. An account may be used only by the person or organisation for which authorised access was provided.

Users are responsible for protecting credentials, devices and account access, and for notifying LabourDeskApp through the public support address if unauthorised access is suspected.

Labourdesk (Pty) Ltd may take reasonable steps to protect an account or the platform where a security concern is identified.

LabourDeskApp may be used for lawful employer labour-relations and workplace-management purposes within the selected plan, available functionality and the user's authority.

Users must not use the website or platform in an unauthorised, unlawful, misleading, abusive or technically harmful way.

The customer and authorised users remain responsible for the accuracy, relevance, completeness and lawful handling of the information they provide. LabourDeskApp does not independently verify every fact entered into an employer workspace.

The customer remains responsible for workplace decisions, instructions, communications and actions taken using platform information.

Documents, guidance and other outputs are working material based on available functionality and information supplied by the user. Every output must be reviewed, corrected where necessary and assessed against the facts and purpose before use.

The existence of an output does not mean that a process is appropriate, complete or legally compliant in every circumstance.

LabourDeskApp does not replace professional legal, labour-relations, HR, tax or other specialist advice. Technology and automated assistance support the user's work but do not replace human judgement.

Users should obtain appropriately qualified advice when a matter is urgent, complex, high-risk or requires an assessment of specific rights and obligations.

Platform access is subject to the selected plan, confirmed account status, available functionality and any applicable subscription or service arrangement. Features and service availability are governed by the functionality currently enabled for the selected plan and account.

Operational access may depend on payment confirmation and the entitlements recorded for the account.

Fees and payment arrangements are governed by the selected plan, the information displayed during checkout and any applicable commercial arrangement. The current public checkout uses PayFast to process available plan payments.

Additional billing or commercial terms apply only where they are displayed during the relevant checkout or confirmed in an applicable commercial arrangement.

A customer wishing to change plans should contact LabourDeskApp support. Available options, timing, access implications and any applicable commercial terms must be confirmed before a change is processed.

A plan change takes effect only when it has been confirmed through the supported process and reflected in the applicable arrangement.

Labourdesk (Pty) Ltd aims to operate and improve the platform responsibly. Availability may be affected by maintenance, updates, service-provider dependencies, technical incidents or matters beyond reasonable control.

Continuous, uninterrupted or error-free availability is not promised. Where reasonably practicable, operational issues will be addressed through the available support and maintenance processes.

The LabourDeskApp brand, website, platform design, software, original content and related intellectual property belong to Labourdesk (Pty) Ltd or the applicable rights holder.

A subscription provides limited access to use available functionality for authorised organisational purposes. It does not transfer ownership of the platform or permit unauthorised commercial copying or distribution.

Users must handle confidential and personal information responsibly and limit access to authorised people. Labourdesk (Pty) Ltd will handle personal information in accordance with its published Privacy Policy, applicable arrangements and applicable law.

No term in this document waives rights under the Protection of Personal Information Act 4 of 2013 or other rights that cannot lawfully be waived.

LabourDeskApp may depend on third-party services for functions such as authentication, hosting, storage, payment processing, communications or security. A third-party service may have its own terms and policies.

Labourdesk (Pty) Ltd does not control every aspect of an independent third-party service, but will use such services as reasonably required for platform operation.

Access may be suspended or restricted where reasonably necessary to address suspected unlawful or abusive use, protect platform or account security, respond to a material breach, comply with law or reflect an account's confirmed access status.

Any action should be proportionate to the circumstances and subject to applicable law and any relevant service arrangement.

Access may end in accordance with the account status, applicable subscription or service arrangement, lawful instruction or a material breach of these terms. Customers should contact support to discuss termination or cancellation requirements applicable to their arrangement.

The effective date, access implications and any financial consequences of termination depend on the applicable arrangement and law.

LabourDeskApp provides structured tools and working information, not a promise of a particular legal or workplace outcome. No outcome before the CCMA, a bargaining council, court or other forum is guaranteed.

To the extent permitted by applicable law, the platform is provided on the basis of available functionality and information supplied by users. Rights or remedies that cannot lawfully be excluded remain unaffected.

To the extent permitted by applicable law, Labourdesk (Pty) Ltd will not be responsible for indirect or consequential loss arising solely from reliance on unreviewed outputs, inaccurate user information, unauthorised use or matters outside its reasonable control.

Any liability that cannot lawfully be excluded or limited remains subject to applicable law. This limitation does not remove mandatory rights under the Consumer Protection Act or other applicable law.

To the extent permitted by applicable law, a customer may be responsible for reasonable loss or claims arising directly from that customer's unlawful use, unauthorised information handling or material breach of these terms.

This provision must be applied fairly, proportionately and consistently with rights and liabilities that cannot lawfully be changed by agreement.

The platform and these terms may be updated through controlled improvement as operational requirements, functionality or applicable law develops. The published terms will display a revised Last updated date.

Changes will not retrospectively create unverified payment or service commitments, and mandatory rights remain unaffected.

These terms are governed by the laws of the Republic of South Africa. No specific province, court jurisdiction or compulsory arbitration process is designated by these terms.
